Terms and Conditions for Using Mynt LTD (Trading as MARBL) AI Concierge Services

1. Service Description

Mynt LTD, trading as MARBL, provides an AI-powered concierge service that communicates with customers via WhatsApp. The service assists with inquiries, bookings, and payments for medical aesthetics treatments. The AI concierge is not a substitute for professional medical advice or consultations.

1.2 Service Limitations

The AI concierge operates based on the information provided and does not offer medical diagnoses or personalized treatment recommendations.

2. Customer Consent and Responsibilities

2.1 Consent for Communication

By using MARBL, you consent to receive communications via WhatsApp. You agree that these communications may include appointment confirmations, reminders, and responses to inquiries.

2.2 Consent for Data Processing

You consent to the collection, use, and processing of your personal data as outlined in this Agreement. This includes data related to your identity, contact information, and treatment preferences.

2.3 Accuracy of Information

You agree to provide accurate and up-to-date information and acknowledge that inaccurate information may affect the quality of service.

3. Privacy Policy

3.1 Information We Collect

• Personal Information: We collect your name, contact information, date of birth, andmedical information relevant to your treatments.
• Communication Data: We store the content of your conversations with MARBL, including inquiries and appointment details.
• Usage Data: We collect data on how you interact with our services, such as timestampsand device type.

3.2 How We Use Your Information

• Service Provision: To communicate with you, manage bookings, and provide treatment information.
• Service Improvement: To analyze and enhance the performance of our AI concierge.
• Legal Compliance: To comply with legal obligations and respond to lawful requests.

3.3 Legal Basis for Processing

• Performance of a Contract: To fulfill our obligations under the service agreement.
• Consent: Based on your consent, which you may withdraw at any time.

4. Payments and Fees

4.1 No Fees for End Customers

MARBL does not charge end customers any fees for using the AI concierge service. Any payments made through the service are for the medical aesthetics treatments provided by the medspa clients.

4.2 Fees for Medspa Clients

Medspa clients are charged fees for the use of MARBL’s services. These fees are agreed upon separately and are not covered in this Agreement with end customers.

5. Liability and Indemnification

5.1 Limitation of Liability

Mynt LTD shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

5.2 Indemnification

You agree to indemnify, defend, and hold harmless Mynt LTD from any claims arising from your use of the service or breach of this Agreement.

6. Termination and Suspension

6.1 Termination by User

You may terminate your use of the service at any time by notifying us in writing.

6.2 Termination by Company

We reserve the right to terminate or suspend your access to the service for violations of this Agreement or other reasons deemed necessary.

7. Governing Law and Dispute Resolution

7.1 Governing Law

This Agreement is governed by the laws of the jurisdiction in which Mynt LTD is established.

7.2 Dispute Resolution

Any disputes arising from this Agreement shall be resolved through good faith negotiations. If unresolved, disputes will be submitted to binding arbitration.

8. Miscellaneous

8.1 Entire Agreement

This Agreement constitutes the entire agreement between you and Mynt LTD, superseding all prior agreements.

8.2 Amendments

We reserve the right to amend this Agreement. Continued use of the service constitutes acceptance of any changes.

8.3 Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect.
