Customer Terms

Please read these Customer Terms carefully before booking any treatment through MARBL.
These Terms form a legally binding agreement between you (the "Customer") and MYNT Ltd, a company registered in England and Wales ("we," "us," or "MARBL").
Our registered office address is: Flat 23 Highbury House, 5 Highbury Crescent, London, England, N5 1RN.
By making a booking through the MARBL Marketplace (the "Platform"), you agree to these Terms.
1. Overview of Services
1.1 MARBL operates a digital platform that connects customers with independent, third-party clinics offering medical aesthetics services (the "Clinics").
1.2 MARBL facilitates bookings, manages deposits, and provides communication tools between you and the Clinic.
1.3 Treatments are provided solely by the Clinic you choose. MARBL does not provide medical or cosmetic treatments and is not a healthcare provider.
1.4 All Clinics listed on the Platform are independent businesses licensed to operate in Florida. MARBL does not employ, direct, or control the Clinics or their practitioners.
2. Eligibility
2.1 You must be at least 18 years of age to use the Platform and book treatments through MARBL.
2.2 By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.
2.3 Certain treatments may have additional age or eligibility requirements as determined by the Clinic and applicable Florida law.
3. Bookings and Deposits
3.1 To secure any booking through MARBL, you are required to pay a $50 USD deposit via our third-party payment provider (e.g., Stripe).
3.2 The deposit is applied against the cost of your treatment. You must pay the balance directly to the Clinic on the day of your appointment.
3.3 If the treatment cost is less than the deposit amount, the deposit will be adjusted accordingly.
3.4 All prices displayed on the Platform are estimates. Final treatment pricing will be confirmed by the Clinic and may vary based on your individual needs and consultation.
4. Cancellations, Reschedules, and No-Shows
4.1 MARBL enforces a 24-hour cancellation policy for all bookings.
4.2 If you cancel your appointment more than 24 hours in advance, your deposit will be refunded in full.
4.3 If you cancel within 24 hours of your appointment or fail to attend (a "no-show"), your deposit will be forfeited and transferred to the Clinic (net of processing fees).
4.4 If you reschedule more than 24 hours in advance, your deposit will be carried forward to your new appointment.
4.5 If you reschedule within 24 hours, your deposit will be forfeited and a new deposit will be required to secure the new appointment.
4.6 If a Clinic cancels your appointment, your deposit will be refunded in full within 5–10 business days.
5. Payments and Refunds
5.1 Deposits are processed securely by Stripe or other authorized payment processors. MARBL does not store your full credit card details.
5.2 Refunds will be processed to your original payment method within a reasonable period (usually 5–10 business days, depending on your bank).
5.3 Any additional treatments, services, or products purchased in-clinic are payable directly to the Clinic. MARBL is not responsible for these payments.
5.4 You are responsible for any applicable sales or use taxes on the treatments and services provided by the Clinic.
6. Customer Responsibilities
By booking through MARBL, you agree to:
- Provide accurate and truthful information when booking;
- Arrive on time for your appointments;
- Disclose all relevant medical history and health information to the Clinic prior to treatment;
- Comply with pre- and post-treatment instructions provided by your Clinic;
- Notify MARBL and/or your Clinic promptly if you need to cancel or reschedule; and
- Provide informed consent to the Clinic before undergoing any treatment.
7. Medical Disclaimer and Liability
7.1 MARBL may provide general information about treatments through the Platform. This information is for guidance only and does not constitute medical advice, diagnosis, or treatment recommendations.
7.2 MARBL is not a healthcare provider. All assessments of suitability, informed consent, and treatment decisions are the sole responsibility of the Clinic and its licensed practitioners.
7.3 MARBL is not liable for:
- The outcome of any treatment;
- Any dissatisfaction with services provided by Clinics;
- Any injury, side effects, or adverse events arising from treatment;
- The qualifications, conduct, or performance of any Clinic or practitioner; or
- Any representations made by Clinics regarding their services.
7.4 Your contractual relationship for medical services is with the Clinic, not with MARBL. Any claims or disputes regarding treatments must be resolved directly with the Clinic.
7.5 You acknowledge that medical aesthetics treatments carry inherent risks, and you agree to discuss all risks, benefits, and alternatives with your Clinic before consenting to any procedure.
8. Limitation of Liability
8.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARBL'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT OF DEPOSITS YOU HAVE PAID TO MARBL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
8.2 IN NO EVENT SHALL MARBL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.
8.3 SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.
8.4 Nothing in these Terms excludes or limits liability for fraud, gross negligence, willful misconduct, or any liability that cannot be excluded or limited under applicable law.
9. Dispute Resolution
9.1 Informal Resolution. Before initiating any formal dispute resolution proceeding, you agree to first contact MARBL at support@marbl.co to attempt to resolve any dispute informally. We will attempt to resolve the dispute within thirty (30) days.
9.2 Binding Arbitration. If we cannot resolve the dispute informally, you and MARBL agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Platform through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in Miami-Dade County, Florida, unless you and MARBL agree otherwise or the AAA rules provide otherwise.
9.3 Class Action Waiver. YOU AND MARBL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
9.4 Small Claims Exception. Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
9.5 Opt-Out Right. You may opt out of the arbitration and class action waiver provisions by notifying MARBL in writing within 30 days of first accepting these Terms. 10. Data Protection and Privacy
10.1 MARBL collects and processes personal data as necessary to facilitate bookings, deposits, and communications between you and your chosen Clinic.
10.2 Your booking details will be shared securely with the Clinic you choose for the purpose of confirming and delivering your treatment.
10.3 MARBL handles all personal data in accordance with applicable U.S. federal and Florida state privacy laws, including the Florida Information Protection Act of 2014 (FIPA).
10.4 MARBL does not collect, store, or process Protected Health Information (PHI) as defined under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). Any health information you provide directly to a Clinic is subject to the Clinic's privacy practices and HIPAA obligations.
10.5 Our use of your personal data is explained in our Privacy Policy.
10.6 In the event of a data breach affecting your personal information, MARBL will notify you in accordance with applicable law, including within 30 days as required by FIPA.
11. Marketing Communications
11.1 MARBL will only send you marketing messages (such as promotions or updates) where you have specifically opted in to receive them or where permitted by applicable law.
11.2 You can withdraw your consent or unsubscribe at any time using the link or instructions provided in each message, or by contacting us at support@marbl.co.
11.3 Even if you opt out of marketing communications, we may still send you transactional messages related to your bookings and account.
12. Termination and Suspension
12.1 MARBL may cancel or refuse your booking, or suspend or terminate your access to the Platform, if you breach these Terms or act in a way that may harm MARBL's reputation, operations, or customers.
12.2 You may stop using the Platform at any time. To close your account, contact us at support@marbl.co.
12.3 Upon termination, any pending deposits will be handled in accordance with Section 4 of these Terms.
13. General Terms
13.1 Governing Law. These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
13.2 Venue. For any matters not subject to arbitration, you agree to submit to the personal jurisdiction of the state and federal courts located in Miami-Dade County, Florida.
13.3 Changes to Terms. MARBL may update these Terms from time to time. Material changes will be notified to you by email or through the Platform. Continued use of the Platform after such updates constitutes your acceptance of the revised Terms.
13.4 Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and MARBL regarding your use of the Platform.
13.5 Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
13.6 Waiver. MARBL's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
13.7 Assignment. You may not assign or transfer these Terms or any rights hereunder without MARBL's prior written consent. MARBL may assign these Terms without restriction.

14. Additional Florida Disclosures
14.1 Under the Florida Deceptive and Unfair Trade Practices Act (FDUTPA), you may have additional rights if you believe you have been subject to unfair or deceptive trade practices. For more information, visit the Florida Attorney General's Consumer Protection Division at www.myfloridalegal.com/consumer-protection.
14.2 Nothing in these Terms limits any rights you may have under applicable Florida consumer protection laws that cannot be waived by contract.
By booking through MARBL, you confirm that you are at least 18 years of age, have read, understood, and agreed to these Terms, and consent to receive electronic communications from MARBL.
